The nonsense has been stayed. It was inevitable--and legally correct. The Sixth Circuit panel was Alice Batchelder (appointed by G.H.W. Bush), Ronald Gilman (Clinton) and Julia Gibbons (G.W. Bush). Interestingly, the order is thin and terse even for a stay--which might itself be a clue. In just two pages, the Court recited the four part test for stays, focused on the first prong ("a substantial likelihood of success on the merits"), and said the minimum, "After careful review, we conclude that this standard has been met in this case."
I predict a reverse with no dissent.
