I've argued, neither the
Intelligence Identities Protection Act of 1982 (
50 U.S.C. § 421 in particular) nor the Espionage Act (
18 U.S.C. § 793)
appear to criminalize disclosure of
Valerie Plame's identity. On Friday,
Murray Waas, writing in the National Journal, speculates the Special Prosecutor agrees, and now is focusing on "making false statements to investigators or with obstruction of justice."
